General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.
For Germany, the following applies: According to § 13 BGB (German Civil Code), consumers are any natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
The following applies to Austria: In the following terms and conditions, “consumer” refers to the “consumer” within the meaning of the Consumer Protection Act (KSchG).
The following applies to Switzerland: In the following terms and conditions, “consumer” refers to the “consumer” under Swiss law.
2. Contractual partners, conclusion of contract, correction options
The purchase contract is concluded with victorioso nutrition GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the products in your shopping cart by clicking on the order button. Immediately after submitting your order, you will receive a confirmation email.
3. Contract language, contract text storage
The language(s) available for the conclusion of the contract: German, English
We will store the contract text and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery
4.1 Shipping
Standard shipping within Germany is free of charge.
4.2
We ship the products to the delivery address specified during the ordering process.
We only deliver by mail. Unfortunately, it is not possible to pick up the goods yourself.

The prices stated at the time of the order apply. These are total prices and include the statutory value added tax.

The following payment methods are generally available in our shop.
Credit card
You enter your credit card details during the order process. Your card will be charged immediately after placing the order.
PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.
PayPal may offer registered PayPal customers selected at its own discretion additional payment methods in their customer account. However, we have no influence on the offering of these methods; any additional payment methods offered individually are governed by your legal relationship with PayPal. You can find further information on this in your PayPal account.
Apple
In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information will be provided during the ordering process.
Klarna
In cooperation with the payment service provider Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with the respective payment option and during the ordering process.
Klarna credit card
You enter your credit card details during the ordering process. Your card will be charged by Klarna immediately after placing the order. No address or credit check will be carried out.
6. Retention of title
The product remains our property until full payment has been received.
For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
7. Warranty and guarantees
7.1 Liability for defects
The statutory liability for defects applies.
For consumers based in Switzerland, the following applies:
You should check the condition of the item received as soon as is reasonably possible after receipt and, if there are any defects for which the seller is responsible, notify the seller immediately. If the consumer fails to do so, the purchased item shall be deemed approved, unless the defects were not apparent during the customary inspection. If such defects become apparent later, notification must be made immediately upon discovery, otherwise the item shall also be deemed approved with regard to these defects.
Please return the defective product to us with a description of the defect. You shall bear the transport costs. We shall provide warranty by remedying defects. This shall be done at our discretion either by eliminating the defect (repair) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of minor defects. A right to a price reduction is excluded.
7.2 Guarantees and customer service
Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.
8. Liability
We shall always be liable without limitation for claims based on damage caused by us, our legal representatives, or vicarious agents
- in the event of injury to life, limb, or health
- in the event of intentional or grossly negligent breach of duty
- in the event of warranty promises, if agreed, or
- to the extent that the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
9. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here.
Important note: The online dispute resolution (ODR) platform will be permanently discontinued on July 20, 2025. The submission of complaints on the ODR platform will therefore be discontinued on March 20, 2025. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
